Data Privacy Policy
TM Photography & Design values your privacy and because of this data may ONLY be used by us to advise you of products, services and special promotions only and WILL NOT be passed to third parties without your prior permission. We may contact you by post, telephone, SMS text or email. Users may choose not to receive these mailings by selecting to be removed from our mailing list.

The Client(s) hereby agree(s) that any photographs taken by TM Photography may be submitted to any photographic exhibition or competition, or to any newspaper, magazine or other periodical with a view to publication, display in a portfolio of work, or otherwise used by TM Photography for promotional purposes. This does not mean that TM Photography can sell your picture to anybody or make any money from any sale of your picture unless formally agreed in writing from you.

Refund Policy
We offer a 24hour cancellation period of your order once placed. But as your product is a customised product we cannot refund money if the wrong order is placed or you change your mind. If any product is faulty on delivery money will be refunded in full if returned within 28 days of receipt.

Terms & Conditions
1: The copyright in all photography created by TM Photography & Design Ltd (TM Photography) shall be and shall remain the property of TM Photography in accordance with the Copyright, Designs and Patents Act 1988.
1a: A deposit shall be required when booking a photoshoot, this deposit is non refundable, should you, cancel or change the appointment in less than 24 hrs, you arrive to late for the shoot to be undertaken within the allotted time or you fail to attend.
1b: TM Photography shall process your order in accordance with the date on which that order was received. If you are planning to use your order for mail outs or agents books it is your responsibility to order your prints in time for publication or mail out deadlines, there is in place a £20 charge for urgent orders which is designed to stop this system being abused. Please do not try to jump this queue as refusal often offends. (Please bear in mind that in busy periods delivery can take upto 28 days for prints and up to 6 weeks for framed prints).
2: The placing of an order by the Client(s) and the acceptance of that order by TM Photography brings into being a contract on TM Photography's terms and conditions as detailed in the following paragraphs.
3: All orders shall be submitted via the internet or in writing on TM Photography's standard order form. No terms and conditions relating to any detail of the order that are not included on the standard order form shall be binding on TM Photography.
4: In some circumstances, and entirely at its own discretion, TM Photography may accept an order given orally by an existing or former Client who has had notice of these terms and conditions; and these terms and conditions shall apply equally to an order given or received orally.
5: In the case of TM Photography accepting an order given orally, the Client(s) shall complete a standard order form as soon as practicable and, in the absence of a completed standard order form, TM Photography shall accept no liability for any error in executing the order.
6: TM Photography reserves the absolute right to refuse to accept any order whatsoever and for whatever reason, and particularly in cases where TM Photography has reason to believe that acceptance and execution of that order will lead to a breach by TM Photography of the laws of obscenity, libel or copyright, or to the aiding, abetting or condoning of such a breach by any third party.
7: The prices payable by the Client(s) for the photography and prints shall be in accordance with TM Photography's price list ruling at the time of the order. TM Photography reserves the right to change or alter it's price list without prior notice to the Client(s). TM Photography shall notify Client(s) if the total price of the order has risen more than £20.00, otherwise TM Photography shall complete the order and invoice for the outstanding amount with order. TM Photography shall retain absolute right to refuse to execute any order until full payment has been received and funds cleared in TM Photography's Bank Account
8: Settlement of accounts shall be by, cheque/postal orders or credit/debit card or by secure internet payment via Worldpay. All cheques and postal orders shall be made payable to TM Photography & Design Ltd. In the event of a cheque not being honoured on first presentation, for whatever reason, TM Photography reserves the right to charge an administration cost of £20.00, and another £20.00 for each subsequent representation of the cheque.
9: TM Photography will take all reasonable care in the execution of the photography. In the event of a failure, the liability of TM Photography shall be limited to a full refund of all money paid in respect of that booking.
10: It shall remain the responsibility of the Client(s) to ensure adequate and appropriate insurance cover against any failure of the photography, howsoever caused.
11: All sizes quoted are nominal and may be subject to a margin of error. TM Photography shall accept no liability for such minor variations in size.
12: TM Photography may from time to time have to outsource work to subcontractors, although all precautions are taken TM Photography accepts no liability should materials be damaged or lost in transit.
13: TM Photography runs a policy of three to twenty eight days delivery. Should deliveries go beyond this point TM Photography accepts no liability for any loss for what ever reason.
14: The Client(s) hereby agree(s) that any photographs taken by TM Photography may be submitted to any photographic exhibition or competition, or to any newspaper, magazine or other periodical with a view to publication, display in a portfolio of work, or otherwise used by TM Photography for promotional purposes. This does not mean that TM Photography can sell your picture to anybody or make any money from any sale of your picture unless formally agreed in writing from you.
15: All photographic negatives/digital images created by TM Photography shall remain the property of TM Photography, and TM Photography undertakes to file and store all such negatives/digital images safely and to make them available for future reproduction by TM Photography for a period of three years. Photographic prints will become and remain the property of the Client(s) . However, for avoidance of doubt, the Client(s) specifically acknowledge(s) that ownership of prints does not imply ownership of the copyright in the images or on them (which remains the property of TM Photography) or any right to reproduce, or to authorise the reproduction of, such images.
16: Where possible TM Photography shall endeavour to comply with Client(s) specifications on such items as finish and cropping of photographs, however where applicable TM Photography reserves the absolute discretion on the composition and materials used in the production of the final print. On the lack of any instructions from the Client(s) TM Photography shall determine materials used.
17: Unless specifically agreed by TM Photography in writing, any date or time specified for the completion of a commission or order, whether by the Client(s) or TM Photography, shall be an estimate only, and TM Photography shall not be liable for any loss to the Client(s) or to any third party resulting from any reasonable delay in completing the commission or order.
18: Delivery of completed orders will be by 1st or 2nd Class Royal Mail service (orders over £40.00 will be sent recorded delivery) or TM Photography's designated courier service. Where applicable TM Photography reserves the right to charge extra should the Client(s) specifically request a special delivery arrangement or the postage charge is increased due to the delivery address been overseas.
19: The eight week period for the ordering of free print(s) shall start 3 days after posting of contact sheet. Your files/negatives will be date stamped for this purpose and therefore this date stamp shall be the TM Photography official marker for this time span. Failure to order your free prints within eight weeks will result in all prints ordered being charged at the appropriate price according to TM Photography's ruling price list at time of order.
